Motion for a European 合法博彩网站 resolution on Iraq, notably the situation of women鈥檚 rights and the recent proposal to amend the Personal Status Law

-听having regard to its previous resolutions on Iraq,

听

- 听having regard to the Partnership and Cooperation Agreement between the European 听 Union and its Member States, of the one part, and the Republic of Iraq, of the other 听 part,

听

- 听having regard to Iraq's听 adopted in 1959, which governs matters 听 of marriage, divorce, child custody and inheritance in Iraq,听 听

听

- 听having regard to the Convention on the Rights of the Child (CRC), acceded to by Iraq 听 on 1994,

听

- 听having regard to article 23(3) of the International Covenant on Civil and Political 听Rights 听 (ICCPR), of which Iraq has been a State Party since 1971 that no marriage 听 shall be entered into without free and full consent of the intending spouses,

听

- 听having regard to Rule 150 of its Rules of Procedure,

听

A. 听whereas the recent proposal to amend the Personal Status Law, could legalize child 听 marriage for girls and boys;

听

B. 听whereas the proposal would legalize unregistered marriages, and allow religious 听leaders, to finalize them; whereas according to a 2021 report by the U.N. Assistance 听 Mission in Iraq (UNAMI) 22 percent of unregistered marriages involves girls under 听 14;

听

C. 听whereas under the proposal, couples entering into a marriage contract can choose 听whether to apply the provisions of the Personal Status Law or the provisions of 听 specific Islamic schools of jurisprudence; whereas this would mean that sect, rather 听 than citizenship, determines the rights afforded to Iraqis in their personal lives, 听 effectively creating separate legal systems for different sects and further 听 entrenching sectarianism in Iraq;

听

D. 听whereas the proposed amendments would have negative consequences听on women in 听 personal status matters, including marriage, divorce, inheritance and child custody;

听

E. 听whereas 73 percent of respondents surveyed by the Iraq Polling Team expressed 鈥渟trong听 听 opposition鈥� to the changes to the 1959 law;

听

1. 听Calls upon the Iraqi 合法博彩网站 to reject the proposed amendments to the Personal 听 Status Law No. 188 of the year 1959;

听

2. 听Calls on the EU and its Member States to condemn the proposed changes to the 听Personal Status Law;

听

3. 听Calls on EU and its Member States to express their concerns about the proposed 听changes to the Personal Status Law to the Iraqi authorities;

听

4. 听Expresses its support for women鈥檚 and children鈥檚 rights campaigners and civil society 听 groups 听 protesting across the country against the recent proposal to amend the Personal 听 Status 听 Law;

听

5. 听Instructs its President to forward this resolution to the Government and 合法博彩网站 of 听 the Republic of Iraq, the Vice-President of the Commission/High Representative of 听 the Union for Foreign Affairs and Security Policy, the Commission, the EU 听 Member States, the United Nations High Commissioner for Human Rights and the 听 UN Special Rapporteur on violence against women and girls.
