European Ϸվ resolution on the latest developments in the National Assembly of Venezuela

Ϸվ,

having regard to the Constitution of the Bolivarian Republic of Venezuela,

having regard to the principle of non-intervention laid down in the UN Charter,

having regard to the declaration by the Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy (VP/HR) on behalf of the European Union of 6 January 2021 on Venezuela,

having regard to the report presented by the Committee of International Observers on 7 December 2020,

having regard to the final reports on the parliamentary election by the Sures NGO for the study and defence of human rights in Venezuela and by the World Peace Council,

having regard to the study of the Center for Economic and Policy Research of April 2019 entitled ‘Economic Sanctions as Collective Punishment: The Case of Venezuela’,

having regard to the statements by the UN Special Rapporteur on the negative impact of the unilateral coercive measures on the enjoyment of human rights on the consequences of these measures in Venezuela,

having regard to the ongoing investigation at the International Criminal Court (ICC) into alleged crimes against humanity committed by the United States through its sanctions policy against the Bolivarian Republic of Venezuela,

having regard to Article 1 of the International Covenant on Civil and Political Rights and Article 1 of the International Covenant on Economic, Social and Cultural Rights, both of which state that ‘all peoples have the right of self-determination’ and that ‘by virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development’,

having regard to Rule 132(2) of its Rules of Procedure,

A.whereas parliamentary elections took place in Venezuela on 6 December 2020; whereas 107 different political organisations participated in the electoral process, including 30 national and 53 regional political parties, and six national and 16 regional indigenous organisations;

B.whereas a part of the opposition decided to boycott the elections; whereas other opposition parties such as Acción Democrática, Esperanza por el Cambio, and Copei did participate in these election and obtained representation; whereas negotiations took place between the Government and the opposition ahead of the election in order to guarantee their participation, which resulted in the liberation of more than 110 prisoners;

C.whereas the Venezuelan National Electoral Council certified the results of the election on 7 December 2020; whereas the two coalitions with the highest numbers of votes were the Gran Polo Patriótico Simón Bolívar with 4321975 votes (69.3%), and the Alianza Democrática with 1169872 votes (18.8%); whereas the Alianza Venezuela Unida and Alternativa Popular Revolucionaria coalitions also obtained representation;

D.whereas on 5 January 2021, the National Assembly celebrated its constitutive session for the period 2021-2026; whereas Jorge Rodríguez was elected President of the National Assembly, Iris Varela was elected First Vice-President, Didalco Bolívar was elected Second Vice-President, Rosalba Gil Pacheco was elected Secretary and Inti Inojosa was elected Sub-Secretary;

E.whereas the internal economic and social situation in Venezuela has deteriorated enormously as a consequence of increasing US and EU economic and financial sanctions, leading to hyperinflation, supply shortages, growing poverty, and a scarcity of medicines and medical equipment;

F.whereas the US State Department has continued to threaten Venezuela with more sanctions that would have a further impact on the situation of the Venezuelan population;

G.whereas unilateral coercive measures are contrary to established international law; whereas the UN, and in particular its Special Rapporteur on the negative impact of unilateral coercive measures on the enjoyment of human rights, has repeatedly stressed this; whereas sanctions cause disruption to any state and, when they harm the economy, can have a devastating impact on the citizens of developing countries;

H.whereas the UN High Commissioner for Human Rights has stated that the sanctions imposed on Venezuela result in people’s fundamental human rights being denied, including their economic rights and rights to food and health, and has called for a political dialogue to overcome Venezuela’s current challenges;

1.Takes note of the results of the Venezuelan parliamentary election and of the newly constituted National Assembly;

2.Welcomes the call to dialogue between parties supporting the government and opposition parties, made by the National Assembly’s President Jorge Rodríguez during the constitutive session; welcomes the creation of a Committee for Dialogue, Reconciliation and Peace in the National Assembly to promote this dialogue;

3.Welcomes the negotiations between parties supporting the government and opposition parties over the distribution of institutional roles in the newly elected National Assembly; takes note of the election of opposition leader Timoteo Zambrano as chair of the Foreign Affairs Committee;

4.Recalls that an inclusive dialogue between the Venezuelan political forces within the constitutional framework of Venezuela is the only way to solve the country’s political problems; calls on the VP/HR to maintain and increase dialogue with the Venezuelan authorities and political actors in order to contribute to this dialogue;

5.Supports the efforts of democratic forces, the Venezuelan Government, the democratic opposition and the Venezuelan people to find answers to their political and economic challenges for themselves and to promote the strengthening of national dialogue in Venezuela;

6.Welcomes the positive steps taken by VP/HR Josep Borrell towards the recognition of the institutional reality of the Bolivarian Republic of Venezuela; calls for full recognition of the National Assembly and the other institutions of the Bolivarian Republic of Venezuela in order to re-establish normalised and mutually beneficial relations between the European Union and Venezuela;

7.Recalls that common challenges such as the fight against the COVID-19 pandemic and the achievement of the Sustainable Development Goals can only be faced through mutual cooperation and with institutional recognition;

8.Condemns the imposition of sanctions and urgently calls for them to be lifted; notes that it is estimated that over 40000 people have died since 2017 as a direct consequence of the sanctions imposed, which have limited Venezuela’s access to the international food and medicine markets; condemns the fact that these sanctions have not been lifted during the COVID-19 pandemic, as they directly affect the right of the Venezuelan people to receive adequate healthcare;

9.Stresses that the sanctions imposed on Venezuela continue to inflict very serious harm on human life; takes the view that these sanctions fit the definition of collective punishment of the civilian population as described in both the Geneva and Hague international conventions, making them illegal under international law and treaties;

10.Expresses concern about the alleged corruption cases affecting Juan Guaidó, who is accused of personally having taken control of Venezuelan assets abroad worth over USD40billion; recalls that this was possible because several governments granted him access to assets and funds belonging to the Bolivarian Republic of Venezuela; calls on the EU Member States to unblock all Venezuelan funds being held in their banks and allow for them to be transferred to the Bolivarian Republic of Venezuela; welcomes, in this sense, the transfer of Venezuelan funds formerly blocked in the Bank of Spain to the Pan American Health Organization to deal with the consequences of the COVID-19 pandemic in coordination with the Venezuelan Government;

11.Instructs its President to forward this resolution to the Council, the Commission, the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy, the parliaments and governments of the Member States, the Government of Venezuela and the Euro-Latin American Ϸվary Assembly.
