Motion for a European Ϸվ resolution on torture and criminal prosecution of Ukrainian minors Tihran Ohannisian and Mykyta Khanhanov by the Russian Federation

Ϸվ,
having regard to its previous resolutions on Ukraine and Russia, in particular its resolutions of 7 April and 19 May 2022;
having regard to the European Convention on Human Rights;
having regard to the United Nations Convention on the Rights of the Child (UNCRC);
having regard to Rule 144 of its Rules of Procedures;
- whereas on May 24, 2023, Russian authorities charged, under Article 281 of the Criminal Code , Tihran Ohannisian and Mykyta Khanhanov, both born in 2006, with allegedly planning acts of sabotage on the railway in the temporarily occupied Berdyansk;
- whereas since 30 September 2022 the teenagers have been subject to brutal interrogation by the Russian authorities, using beatings and electric shock torture along with demands for confessions for the preparation of sabotage on the Melitopol railway, allegedly to prevent units of the Russian armed forces from receiving the supplies necessary for conducting military operations in Ukraine; whereas they are now awaiting their trial;
- whereas Ukraine’s Centre for the National Resistance claims to never involved minors in Ukrainian resistance actions in the occupied territories;
- strongly condemns the process against Tihran Ohannisian and Mykyta Khanhanov and the brutality they have been facing and demands immediately to end the proceedings against them and to allow them to leave the temporarily occupied territory of Ukraine and the Russian Federation;
- condemns those involved in these proceedings and in the alleged torture of them; calls for those responsible, particularly at the Investigative Division of the Temporary Directorate of the Ministry of Internal Affairs of Russia in the Zaporizhzhia oblast, to be added to the EU sanctions list; calls for further efforts to secure the release of the two and their safe return to the territory controlled by the Ukrainian government or to a third country safe for them; calls upon International Committee of the Red Cross to facilitate the process;
- denounces the severe violations of human rights of children by the Russian regime and the attempts at Russification and depriving Ukrainians of their national identity; condemns the complicity of the Belarusian regime in the illegal transfer of Ukrainian children; reiterates its call for the EU to take needed measures to prevent and act against forcible deportation of Ukrainian children by Russian authorities and their placement with so called “adoptive” families, despite existence of their parents or legal guardians in Ukraine;
- urges the Russian authorities to fully abide by its obligations under international law and to ensure the safety and well-being of Ukrainian children while in Russia and in the Russian-occupied territories, and to protect them from the risks posed by the war and its effects;
- calls for this resolution to be translated into Russian and Ukrainian; instructs its President to forward this resolution to the HR/VP, the Council, the Commission, the governments and parliaments of the Member States, the OSCE, the Council of Europe, the United Nations, the ICRC and the Russian authorities;
