Motion for a European Ϸվ resolution on the case of Dr Gubad Ibadoghlu, imprisoned in Azerbaijan

Ϸվ,

having regard to the Rule 144 of its Rules of Procedure,

  1. Whereas on 23 July 2023 world-renowned economist and prominent opposition figure Dr Gubad Ibadoghlu was brutally attacked and arrested outside Baku together with his wife, who was released later that day; whereas Dr Ibadoghlu was sent to pre-trial detention for a term of nearly four months on charges of “production, acquisition, or sale of counterfeit money or securities by an organised group”; whereas according to the Ministry of Interior of Azerbaijan his arrest is part of an operation against supporters of Fethullah Gülen, considered as terrorist by the Turkish government; whereas, if convicted, Dr Ibadoghlu faces from 8 to 12 years imprisonment;
  2. Whereas he is known for his criticism of the government, in particular as regards corruption, inefficient public finance management and lack of budgetary transparency; whereas Dr Ibadoghlu serves as Chairman of the Azerbaijan Democracy and Prosperity Movement, which has been continuously denied registration as a political party since its establishment in 2014;
  3. Whereas he has been the target of a smear campaign since he founded in June an organisation in the United Kingdom to support Azerbaijani youth abroad, to be funded by donations and assets confiscated from corrupt Azerbaijani elites abroad, such as those partially recovered by the UK in the Azerbaijani Laundromat anti-corruption case;
  4. Whereas the arrest of Dr Ibadoghlu constitutes an act of retaliation for his peaceful criticism and political and civic activities;
  5. Whereas the arbitrary detention of Dr Ibadoghlu is not an isolated case and falls in the long-standing government pattern of arbitrary arrests, indefinite detentions, severe beatings, torture and forced disappearances;
  6. Whereas Azerbaijani human rights activists are also threatened outside national borders, as for example Mahammad Mirzali, who survived three assassination attempts while recognized as a refugee in France, because of the persecution he suffered in his country for denouncing corruption of the regime;
  7. Whereas Dr Ibadoghlu suffers from serious health condition and his health has significantly deteriorated while in detention due to unsafe prison conditions and denial of access to his medication;

  1. Denounces the circumstances of the arbitrary arrest of Dr Ibadoghlu and his wife and the violations of their rights of due process in detention;
  2. Calls for immediate and unconditional release of Dr Ibadoghlu; urges the Azerbaijani authorities to provide him with proper medical care, food and clean drinking water while in detention;
  3. Reminds the Azerbaijani government of its international obligations to protect dignity and rights of detainees and ensure they are provided with adequate medical care, humane detention conditions and protection from mistreatment;
  4. Urges the Azerbaijani authorities to release all political prisoners, independent journalists and human rights defenders, drop all politically motivated charges against them and stop extra-territorial repression;
  5. Calls for EU sanctions under the EU Magnitsky Act to be imposed on Azerbaijani officials who have committed serious human rights violations;
  6. Instructs its President to forward this resolution to Azerbaijan and international institutions.
