Motion for a European Ϸվ resolution on the case of Dr Gubad Ibadoghlu, imprisoned in Azerbaijan

Ϸվ,
–having regard to its previous resolutions on Azerbaijan,
–having regard to the Universal Declaration of Human Rights,
–having regard to the International Covenant on Civil and Political Rights,
–having regard to the European Convention on Human Rights,
–having regard to Rules 144(5) and 132(4) of its Rules of Procedure.
- whereas Gubad Ibadoghlu, renowned political economist and chairperson of the Azerbaijani Movement of Democracy and Prosperity, was arbitrarily detained on 23 July 2023 and remains in prison on dubious charges with limited contacts to his family and lawyer and reportedly subject to inhumane treatment;
- whereas his family members and lawyer have been alerting about his rapidly deteriorating health due to the lack of adequate medical treatment of his serious medical condition, poor detention conditions and inhumane treatment, in violation of his human rights;
- whereas Gubad Ibadoghlu’s publications on corruption within the state institutions of Azerbaijan, the procedural violations in his case and the government’s notorious and recently intensified crackdown against political opposition and civil society clearly indicate that his detention is aimed at silencing one more prominent government critic;
1.Urges the Azerbaijani authorities to immediately ensure access to health care and medication, cease any inhumane and degrading treatment and unconditionally release Gubad Ibadoghlu and all other political prisoners;
2.Denounces the crackdown against political opposition and civil activists in Azerbaijan and the misuse of fabricated criminal investigations to suppress criticism of the authorities and political dissent;
3.Calls on the High Representative, the EEAS and the Member States to condemn the serious human rights violations and breaches of democracy in Azerbaijan and to raise cases such as Gubad Ibadoghlu’s in all bilateral meetings as well as in the negotiations of a future partnership agreement;
4.Underlines that the deepening of cooperation with Azerbaijan should be subject to the country respecting its commitments as a member of the Council of Europe and the Organisation for Security and Cooperation in Europe and that the release of all political prisoners is an indispensable condition for signing a partnership agreement with the EU;
5.Instructs its President to forward this resolution to the Vice-President of the Commission/ High Representative of the Union for Foreign Affairs and Security Policy, the Council, the Commission, the governments and parliaments of the Member States, the Council of Europe, the OSCE and to the President, Government and Ϸվ of Azerbaijan.
