Alex Agius Saliba, rapporteur. – Madam President, Madam Ombudsman, colleagues, first of all, let me begin by expressing my gratitude to the shadow rapporteurs for their constructive collaboration and also commitment on working together on this very important report.
I would also like to commend the remarkable work of Ms Emily O'Reilly and her team. The importance of the European Ombudsman role in protecting citizens' rights and strengthening public confidence in all EU institutions cannot be emphasised enough.Over the past eleven years, O'Reilly and her office have done an outstanding job in enhancing transparency, enhancing accountability, enhancing the effectiveness of the EU's administration.
In my report, I address a number of issues and highlight the work of the Ombudsman for the past year.
First of all, the Commission's maladministration due to systemic and significant delays in processing requests for public access to documents is – and remains – a key concern. I stress in my report that such documents may be in written form or paper or stored electronically. I also suggest in my report to revise Regulation 1049/2001 on public access to documents, and recall several instances where the Commission failed to grant access. For instance, regarding the EU's soil, forest and climate adaptation strategies or exchange of text messages between the Commission President and the CEO of a pharmaceutical company.
The report stresses the importance of respecting fundamental rights in migration-related actions. It emphasises the obligations of all EU institutions, all EU bodies, all EU agencies to uphold human rights and fundamental freedoms. In this context, the report notes the Commission's efforts to conduct fundamental rights impact assessment for EU-funded migration management facilities.
The Ϸվ's response to Qatargate, particularly the new Code of Conduct for Members of the European Ϸվ on integrity and transparency, underscores the need for its proper implementation and monitoring. I stress the importance of the Ϸվ and the Commission consistently paying close attention to direct and indirect lobbying activities in order to identify gaps and weaknesses that could compromise transparency, that could compromise accountability.
The report highlights the risk of conflicts of interest arising from 'revolving door' cases, where senior staff of EU institutions or bodies transition to the private sector. It underscores the need of the highest ethical standards, including transparency and public accountability. Furthermore, the report raises concerns about the Commission's interactions with the tobacco industry.
Transparency and functioning in EPSO selection procedures are vital to ensure a fair and inclusive recruitment process, which is crucial for maintaining the integrity of the EU's institutions. The report urges selection tests when it comes to addressing EPSO issues and also ensuring that technical requirements do not disadvantage candidates.
The European Accessibility Act, adopted in 2019, was a vital step towards improving the life of 87million persons with disabilities, facilitating access to essential services like transport, banking, computers, television, e-books and online shops. Yet, despite the 2022 deadline, Member States have failed to fully transpose it. Delays confirm the ongoing infringements that we have. The violation of EU law undermines disability rights. I call on the Ombudsman to prioritise this crucial issue with the UNCRPD framework to resolve it as a matter of priority.
Last but not least, I am proud to stress that during the committee vote, the report received an overwhelming majority supported by all political groups. This reflects our shared commitment to enhancing the efficiency and the transparency of all EU institutions, bodies and agencies for the benefit of all our citizens.
EMILY O'REILLY, European Ombudsman. – Madam President, Executive Vice-President Fitto, good evening everybody and let me begin by thanking Rapporteur Saliba, the shadow rapporteurs and the Petitions Committee for the early Christmas gift of their strong endorsement of our work in 2023. As this is my last time presenting my office's annual report, allow me to say that I am also immensely grateful for the consistent support over the years from both the committee and Ϸվ as a whole.
It has been a year of many changes, with a new Ϸվ and a new Commission. The decisions you will take in the coming years will determine how the EU confronts an increasingly turbulent and uncertain global order, a world overflowing with challenges ranging from the economy and international trade to global security and potential climate catastrophe. The actions of the EU institutions will also define how our Union lives up to the values that we talk so much about: transparency, accountability, respect for the rule of law and the protection of fundamental rights. Every decision taken must have the citizen, the public interest, front and centre, because it is in the name of every EU citizen that you will make the policy and other choices here in this chamber and throughout the EU administration.
In 2023, my office saw a slight rise in the number of complaints received and we opened more inquiries than in 2022. Transparency and accountability accounted for the greatest proportion of cases, followed by a culture of service on the part of the institutions and recruitment issues.
In March, Ϸվ unanimously approved my special report on systemic delays in the European Commission's handling of access to documents requests. This was my first special report since 2018, when I had also asked for your support in ensuring transparency in the Council's legislative process. I took this rare step again, because of the serious negative effect that long access delays can have on citizens' ability to participate effectively in the decision-making process and hold the EU institutions to account. I thank you again for your overwhelming support and reiterate my call on the Commission urgently to deal with this matter.
In 2023, I also opened an own-initiative inquiry into how the Council, Ϸվ and the Commission apply EU law and case law when it comes to public access requests for legislative documents. While Ϸվ received too few access requests within the scope of my inquiry to draw any meaningful conclusions, I found that the Council and the Commission applied the exceptions under the EU access to documents law far too broadly. Their reasoning in many cases, including arguments concerning the protection of legal advice or that disclosure of documents could result in external pressure or public misinterpretation, have already been dismissed by the European Court of Justice in cases taken to it over the last number of years.
I ask both institutions to disclose legislative documents promptly from now on and to refuse access only in highly exceptional circumstances. 'External pressure' in particular is not a reason to deny access, as it is an obvious and normal part of the democratic law-making process.
I also criticised the Commission's failure to ensure all its departments proactively publish details of all meetings with tobacco lobbyists, as well as its failure to keep minutes of all meetings. I did, however, welcome the fact that the Commission intends further to assess the exposure of its departments to lobbying by the tobacco industry. It has now begun this assessment and provided my office with some preliminary information. We look forward to hearing about the Commission's conclusions, as well as what further measures it intends to take to deal with the risk of undue influence on EU decision-making from the tobacco industry.
Following the tragic drowning of over 600 people when the boat Adriana sank off the coast of Greece in June 2023, I opened an inquiry into how Frontex fulfils its fundamental rights obligations in search and rescue operations. I made some suggestions to Frontex to address shortcomings around issues such as guidelines for emergency signals and ensuring that fundamental rights monitors are sufficiently involved in decision-making on maritime emergencies.
I ultimately concluded, however, that current rules leave the agency too reliant on Member States to act when boats carrying people attempting to migrate or to seek asylum are in distress. My inquiry revealed that as the tragedy unfolded, Frontex made four separate offers to assist the Greek authorities by providing aerial surveillance of the Adriana, but that all of these offers went unanswered.
In September 2023, I made a number of suggestions to ensure greater transparency and accountability around the EUR700-billion-plus Recovery and Resilience Facility. These included asking the Commission to ensure that all Member States set up easy-to-use public portals containing data on funding recipients and to encourage them to publish all national beneficiaries, and not just the 100 receiving the highest amount of funding.
Given the unprecedented size and scope of the RRF, it is especially important that there is accessible information available about the loans and grants it supports. In particular, the public should be reassured that Member States are complying with the conditions attached to the funding they receive.
I could not end this address without also mentioning the fourth edition of our Award for Good Administration. I strongly believe that the role of an ombudsman should not only consist of pointing out what needs to be improved in public administration, but also emphasising what already works well. This award provides a great opportunity to do just that, by bringing much deserved attention to some of the wonderful work being done by EU public servants. The overall winner in 2023 was Eurojust and the Office of the Prosecutor of the International Criminal Court, for their work on guidelines to help civil society collect and preserve evidence of international crimes and human rights violations for future prosecutions.
As you know, my mandate as European Ombudsman is drawing very quickly to a close. During my time in office, I have witnessed many positive developments in the EU administration. These include increased transparency around legislative decision-making and EU trade policy, a strengthened Code of Conduct for Commissioners, the creation of a Frontex complaints mechanism for allegations of fundamental rights breaches, and greater awareness of the potential damage caused by 'revolving door' moves. In addition, I am proud to be leaving behind an office with an 87% overall employee satisfaction rate, and I would like to thank all of my wonderful staff for their outstanding work throughout these years.
This week, tomorrow in fact, you will elect my successor. There are six well-qualified candidates and I feel confident that whomever you choose will further ensure the EU institutions operate in a manner worthy of the public's trust. I am also confident that you will provide them with the same vital support that you have provided to me over these last 11 years.
Raffaele Fitto, Executive Vice-President of the Commission. – Madam President, honourable Members of the European Ϸվ, dear Ms O'Reilly, I am very pleased to take the floor on the European Ϸվ's report and the resolution on the activities of the European Ombudsman in 2023. I want to thank the rapporteur, Mr Saliba, the coordinators of the PETI Committee and all its members involved for this annual exercise, providing the views of the European Ϸվ on the issues that it considers noteworthy in the area of good administration.
As highlighted in the report in the resolution, the work of the European Ombudsman is crucial for improving administrative practices and for promoting accountability, transparency and culture of service. Through the inquiries conducted in 2023, the European Ombudsman addressed a number of very important issues, such as transparency in the work of the institutions, respect for the fundamental rights, respect for procedural rights, ethical issues and compliance with ethical framework, accountability in the decision‑making and the recruitment of EU civil servants.
This is essential for EU citizens, businesses and associations, and for an EU administration that always strives to achieve the high standards of public services. The Commission remains committed to continue doing so. The European Commission is the main addressee of the European Ombudsman's inquiries and initiatives, with 227 inquiries and initiatives out of 372 launched in 2023, representing 62.8% of the total. These figures also reflect the fact that the European Commission is the largest EU institution and has many interactions with EU citizens.
The Commission enjoys excellent cooperation and constructive relations with the office of the European Ombudsman. The fact that it is very rare that an inquiry ends up with the final closing decision of maladministration only in 4.8% of the cases concerning the Commission – 11 cases in total – is an indication that constant dialogue and mutual understanding can provide tangible and concrete results.
I would like to use this occasion to thank the outgoing Ombudsman, Ms Emily O'Reilly, for the excellent work she has done for citizens, businesses and associations and for our institutions in the past 11 years. The Commission remains fully committed to act with due respect and the highest responsibility towards citizens' expectations and demands.
Whenever feasible, the European Ombudsman's solution proposals, suggestions for improvement and recommendations will continue to be taken into account and implemented by the Commission. As usual, the European Commission will duly examine the European Ϸվ's resolution in the coming weeks and will reply to all the issues that concern the Commission, including by providing the relevant updates. Madam President, I look forward to hearing the views of the honourable Members and I thank you for your attention.

Miren, precisamente en la realización de este informe hemos puesto otra vez encima de la mesa una cuestión que es clave, la de la inmigración. Quiero agradecer la valentía que tuvo la señora O'Reilly para señalar que Frontex, una agencia de las instituciones europeas, de la Comisión, tenía importantes deficiencias que podían vulnerar los derechos humanos.
Por eso, sinceramente, no puedo entender como los Grupos PPE y PfE no han aceptado las enmiendas de mejora para que no vuelva a ocurrir una desgracia como la delAdriana, en la que murieron más de seiscientaspersonas, y en cambio se aprueba una enmienda del Grupo PfE que habla de que los derechos de los locales también existen, lo que es absurdo, es innecesario, señorías. Tenemos que defender los valores de la Unión, que es una Unión más justa y más humana.

Először is szeretnék köszönetet mondani O'Reilly ombudsman asszonynak és munkatársainak az elmúlt 11 évben végzett áldozatos munkájáért. 2023-ban is számos, igen fontos kérdéssel foglalkozott, amelyek hozzájárultak ahhoz, hogy növekedjen az EU-s intézmények tevékenységének átláthatósága, (például a dokumentumokhoz való hozzáférés nyilvánosságának elősegítése révén), továbbá csökkenjen a korrupció lehetősége (például a lobbizás szigorítása révén).
Mozgássérült képviselőként szeretném külön megköszönni Önnek, hogy a fogyatékossággal élő személyek jogaival kiemelten foglalkozott. Többek között segített abban, hogy az uniós szervek maguk is végrehajtsák az ENSZ-egyezményt, illetve hogy a tagállamok megfelelően ültessék át az európai akadálymentesítési irányelveket. A Petíciós Bizottság tagjaként meg tudom erősíteni, hogy a fogyatékos emberektől számos petíció érkezett, és ez abban is meg kell erősítse a következő ombudsmant, hogy ezt a munkát, amit a fogyatékosügyben elkezdett az elődje, ezt folytatni kell.
Ami a jövőt illeti, a Patrióta frakció petíciós bizottságának koordinátoraként fokozott figyelemmel fogom a következő ombudsman munkáját figyelni, és remélem, hogy a következő ombudsman véget vet majd a Parlamentben tapasztalható politikai alapú diszkriminációnak, hiszen ez éppúgy tilos, mint ahogy a fogyatékosságon vagy bármilyen más alapú hátrányos megkülönböztetés is. Ennek kapcsán hadd fejezzem ki sajnálatomat, hogy Saliba úr, a most tárgyalt jelentés előadója, egyetlen patrióta módosítót sem fogadott el. Talán ez is „cordon sanitaire“?

Bardzo dziękuję pani O'Reilly za to, że stała przez 10 lat na straży transparentności i uczciwości unijnych instytucji. Zwłaszcza ostatnia kadencja pokazała jednak, że brak przejrzystości procesu decyzyjnego i korupcja to realne i wciąż nierozwiązane problemy. Zgadzamy się z obawami wyrażonymi przez Panią Rzecznik, że wdrażanie i egzekwowanie zasad etycznych po aferze Katargate w Parlamencie wciąż może budzić zastrzeżenia.
Niezwykle ważną kwestią jest także utrudniony proces dostępu do dokumentów oraz decyzja, co zaliczyć do tej kategorii. Korespondencja esemesowa przewodniczącej Komisji z szefem Pfizera w sprawie unijnego kontraktu na zakup szczepionek przeciwko COVID-19 także powinna być publicznie dostępna. Ta kwestia wciąż wymaga pilnej uwagi i nadal niewłaściwie została wyjaśniona.

Jako koordynator Komisji Petycji z ramienia Renew Europe serdecznie dziękuję Pani Rzecznik za ten ostatni rok. Słowa uznania ze strony mojej jako polityka i obywatela, ale także ze strony całej naszej frakcji. Pani ogromny wkład w zwiększenie przejrzystości administracji, Pani pochylenie się nad sprawami obywateli dowodzą, jak odpowiedzialną postawą Pani się wykazała zarówno w tym roku, jak i w trakcie całej 11-letniej kadencji.
Europejski Ombudsman, tak jak rzecznicy praw obywatelskich w państwach członkowskich, musi być jak najbliżej i bronić każdego obywatela. Ma być rzecznikiem, adwokatem i powiernikiem obywateli, którzy czasem gubią się w unijnej biurokracji. Europejski Rzecznik Praw Obywatelskich ma sprawiać, by Unia była bliższa Europejczykowi. To ogromne zadanie. O tym, kto podejmie się trudu, by to zadanie kontynuować, zdecydujemy w tym tygodniu.
Spoczywa na nas, europosłach, bardzo ważna odpowiedzialność, by dobrze i mądrze wybrać. Nie kto będzie lepszym politycznym wyborem, nie kogo chcielibyśmy obdarować tym stanowiskiem. Nie, my mamy wybrać osobę, która sprawi, że Unia zagości w domach naszych obywateli, a nie gdzieś daleko w gmachach Strasburga i Brukseli.

To je ujedno i zadnji izvještaj koji podnosite ovdje u Europskom parlamentu. Zato mi dopustite da u ime grupe Zeleni/EFA ovim putem zahvalim za vaš predani višegodišnji rad na zaštiti ljudskih prava, na zaštiti vladavine prava i jačanja transparentnosti institucija Europske unije.
Posebno želim istaknuti vašu odlučnost u radu na temama koje nisu jednostavne ni ugodne, ali su ključne za očuvanje demokratske kvalitete institucija i stjecanja povjerenja građana. Niste oklijevali da dirate i one koji su možda mislili da su nedodirljivi i zato vam hvala.
Tako ste vrlo precizno i predano u svom mandatu radili na temi migracija. Posebno želim istaknuti vaš rad na užasnoj tragediji utapanja preko 600 ljudi u havariji broda Adriana. I sami ste govorili kako su vas te situacije duboko obilježile. Radili ste i na temama zaštite okoliša, posebno vezano uz pristup informacijama u tom području, gdje ste utvrdili učestale nepravilnosti, tj. osudili Europsku komisiju, koja često nije voljna dati pristup informacijama ili je odugovlačila s odgovorima.
Uvjeren sam kako je vaš hrabar i profesionalan rad, koliko god bio izložen nekim kritikama, naposljetku učinio institucije kvalitetnima. Sutra ćemo izabrati novog pravobranitelja ili pravobraniteljicu i na nama zastupnicima leži odgovornost da ta osoba dosegne one kriterije i standarde koje ste vi postavili.

Rządzący podlegają nieustannej pokusie nadużycia, której ofiarami są nasza wolność, nasz majątek i nasze bezpieczeństwo. Nie tylko przez ostatni rok, ale przez te ostatnie wszystkie lata broniła Pani tych wartości, walcząc z wszechwładzą biurokratów oraz ujawniając niekiedy zakulisowe działania instytucji Unii Europejskiej, o których ludzie mieli prawo wiedzieć.
W ramach tej walki o przejrzystość i uczciwość wśród urzędników ujawniła Pani między innymi potajemne rozmowy szefowej Komisji Europejskiej z przedstawicielami Pfizera w zakresie zakupu szczepionek. Ponadto prowadziła Pani także sprawę Katargate, doprowadzając między innymi do uchwalenia nowych przepisów, które zobowiązują do okazywania większej jawności.
Nasuwa się jednak pytanie, czy to właściwa droga, bo Ombudsman to mimo wszystko urząd, który nadzoruje inne urzędy. Czy konieczność istnienia takiego nadurzędnika nie świadczy o tym, że mamy do czynienia z nadmierną biurokracją oraz centralizacją? Powinniśmy zerwać z tym błędnym kołem i odebrać biurokratom władzę nad naszym zdrowiem, wolnością i mieniem. Zamiast zarządzać biurokracją, powinniśmy ją wyciąć jak złośliwy nowotwór.
W takim ujęciu działalność Ombudsmana jest jak plaster przyklejony na otwarte złamanie. Mimo tego w walce z wszechmocną biurokracją, która nie cofnie się ani o krok, broń w postaci Rzecznika jest lepsza niż żadna. W imieniu grupy Europa Suwerennych Narodów chciałbym Pani serdecznie podziękować za te wszystkie lata ciężkiej pracy, ciężkiej walki z patologiami biurokracji. Postawiła Pani bardzo wysoko poprzeczkę.
Michał Wawrykiewicz (PPE). – Madam President, thank you very much. Madam Ombudsman, first, I would like to thank you for all of your commitment during the whole term of office. But now I want to address two chapters of this annual report: first, fundamental rights, and second, cooperation and communication with EU institutions.
Looking at the experience of my country, Poland, between 2015 and 2023, with the massive devastation of the rule of law, independence of the judiciary – which is definitely one of the fundamental rights of our Union – I would like to stress the role of the European Ombudsman in terms of putting pressure on the European Union institutions to respond quickly and firmly, using all the instruments these institutions have at their disposal. I believe that the key to success in the struggling for the rule of law is effectiveness of European Union institutions, and here I can see also the role of the European Ombudsman.
Murielle Laurent (S&D). – Madame la Présidente, Madame la Médiatrice, chers collègues, ce débat sur le rapport annuel d’activité de la médiatrice européenne est pour moi l’occasion de féliciter MmeEmilyO’Reilly pour l’immense travail accompli depuis près de dix ans. Cela me donne aussi l’occasion de la remercier au nom des citoyens européens pour sa ténacité, son opiniâtreté, sa rigueur et sa volonté absolue de transparence face aux plus hautes instances européennes, dès lors qu’il s’agit de garantir le fonctionnement de la vie publique, mais également le respect de l’état de droit –état de droit dont le plus grand nombre en Europe ne semble pas se préoccuper.
Ces qualités seront indispensables à son successeur ou à sa successeure, dont l’élection aura lieu demain. Ce rôle, trop méconnu, est pourtant primordial pour faire vivre la démocratie européenne et pour la protéger. Je souhaite vivement que le prochain médiateur ou la prochaine médiatrice soit à la hauteur des enjeux, comme MmeO’Reilly l’a été.
Virginie Joron (PfE). – Madame la Présidente, chers collègues, MadameEmilyO’Reilly, Monsieur le Commissaire, d’abord je tiens à saluer l’importance et la qualité, chère madame, du travail que vous avez réalisé depuis dix ans, et spécialement depuis2020, année de la folie COVID-19 –je salue à ce titre les 393enquêtes que vous avez ouvertes pour la seule année2023.
La mauvaise administration est devenue le système. C’est ainsi que l’on dirige l’Europe, et l’on semble penser que c’est normal. Des plaintes, des rapports, des auditions… mais une Commission qui se contente de hausser les épaules et de continuer, comme si de rien n’était. Beaucoup d’hypocrites ici critiquent MmevonderLeyen, mais lui font la bise et lui redonnent l’immunité pendant cinq ans. Ces magouilles politiciennes, les citoyens européens n’en veulent plus. Voyage non déclaré d’Ursula en Grèce, «Qatargate», «Pfizergate», multiples cas de pantouflage: les scandales s’enchaînent, et ils sont ignorés.
Comme médiatrice, vous avez œuvré pour que la Commission européenne mette fin à ses pratiques opaques, ses retards et ses copinage, en vain. Qu’à cela ne tienne: vous pouvez compter sur nous pour demander des comptes à cette nouvelle Commission vonderLeyen. W 2023 roku działalność Europejskiego Rzecznika Praw Obywatelskich, pani Emily O'Reilly była niezwykle istotna. Podobnie jak w poprzednich latach, zwłaszcza w kontekście przejrzystości i odpowiedzialności unijnych instytucji. W mijającym roku Pani Rzecznik prowadziła dochodzenia dotyczące procesu decyzyjnego, legislacji środowiskowej oraz wpływów stron trzecich, co miało szczególne znaczenie po wybuchu afery Katargate. Uważam, że działalność ta przyczyniła się do zwiększenia świadomości na temat przejrzystości Unii Europejskiej, zwłaszcza w sprawach takich jak wymiana wiadomości między przewodniczącą Komisji Europejskiej a firmą Pfizer w kwestii szczepionek czy brak przejrzystości w prawodawstwie środowiskowym. To, co zrobiła Pani O'Reilly, było konieczne i zależy nam na tym, żeby to zaufanie zbudowane także przez Panią zwiększył Pani następca. Oby ten następca miał tyle siły co Pani w pokonywaniu rozlicznych trudności, bo ta funkcja i Pani praca muszą po prostu przynosić pozytywne efekty dla Unii Europejskiej.
Jana Toom (Renew). – Madam President, dear colleagues, Ombudsman, Commissioner, of course, I do have my speaking points. I left them on the table because if you have 15 speakers, everything was already said, right? So I will take a liberty to speak from by heart.
I believe, Emily – sorry for calling you that – you might feel a bit like in the funeral. Everybody is praising you here and forgood reason. You did an outstanding job, and it was our privilege to work with you.So I believe that what we have to do, we have to draw our lessons, and there were a lot of lessons, which we can go ahead with after working with you regarding transparency and all these keywords we have already mentioned here, but the main challenge is to make the right choice tomorrow, because Emily O'Reilly is really leaving behind pretty big shoes to fill.
And let's, colleagues, make our choice, let's be conscious and let's think about O'Reilly's legacy, and fingers crossed that the next Ombudsman will be up to this task.
Alexandra Mehnert (PPE). – Frau Präsidentin, verehrte Kolleginnen und Kollegen Abgeordnete! Was macht eine gute Bürgerbeauftragte, einen guten Bürgerbeauftragten aus?
Auf diese Frage gibt der heute vorgestellte Bericht über den Jahresbericht 2023 über die Tätigkeit der Europäischen Bürgerbeauftragten einige Antworten. Die Bürgerbeauftragte ist die Stimme für Bürgerinnen und Bürger; hier geht es um Vertrauen und um Sichtbarkeit. Denn leider ist das Amt bislang bei Bürgerinnen und Bürgern nicht so bekannt. Das heißt nicht nur Zugang zu Dokumenten und Transparenz, sondern direkter Kontakt zu den Menschen. Der Bericht, den wir heute verabschieden, führt sehr richtig auf, wie wichtig der Kontakt in die Mitgliedstaaten ist– über Multiplikatoren, Zivilgesellschaft und Medien. Ich würde sogar sagen, der Kontakt in die Mitgliedstaaten ist die wichtigste Aufgabe des Europäischen Bürgerbeauftragten.
Morgen wählen wir im Europäischen Parlament das Amt neu. Es freut mich sehr, dass wir gleich mehrere hoch qualifizierte und wirklich gut geeignete Kandidatinnen und Kandidaten haben. Wir können aus den Erfahrungen der vergangenen Jahre lernen, was eine gute Bürgerbeauftragte ausmacht: auch zukünftig ein verstärkter direkter Kontakt zu den Bürgern.
Ana Catarina Mendes (S&D). – Senhora Presidente, Caros Colegas, Senhora Provedora de Justiça Europeia, quero, em primeiro lugar, saudá-la e juntar-me àqueles que, aqui, a felicitaram pelo trabalho e pela coragem do trabalho que teve ao longo dos tempos.
Quero também felicitar o relator pelo trabalho que nos apresenta e pela intervenção que fez e voltar a sublinhar a importância deste relatório naquilo que na proteção dos valores da justiça, da transparência e da promoção da boa gestão dos recursos da União Europeia tem e vinca e sublinha.
Mas queria, sobretudo neste relatório sobre as atividades da Provedoria de Justiça Europeia, saudar a coragem, a bravura e a pertinência de falar sobre as questões das migrações e de falar do respeito pelos direitos humanos destes cidadãos que procuram aqui um porto seguro. E, por isso mesmo, a forma como formulou recomendações à Frontex deve ser sublinhada. Trata-se de direitos humanos, Estado de direito, mas também daquilo que deve ser a nossa proteção da inclusão de todos os cidadãos.
Que amanhã saibamos estar à altura da responsabilidade na escolha que fizermos com o próximo cidadão e o próximo Provedor de Justiça.
Cristian Terheş (ECR). – Doamnă președintă, dragi colegi, Emily O'Reilly merită și trebuie să fie lăudată în Parlamentul European pentru că și-a îndeplinit atribuțiile în favoarea cetățenilor Uniunii Europene.
Am fost unul dintre cei care a susținut alegerea acesteia în 2019 ca Ombudsman, iar activitatea acesteia pe durata celor cinci ani de mandat a fost un exemplu de independență, profesionalism și determinare pe care trebuie să îl urmeze și următorul Ombudsman. Un exemplu de determinare a fost ancheta pe care Ombudsmanul European a făcut-o cu privire la refuzul Comisiei Europene de a publica mesajele text dintre Ursula von der Leyen și șeful Pfizer, Albert Bourla, refuz catalogat de Emily O'Reilly ca administrare defectuoasă sau maladministration.
În România, dacă un primar sau oficial public negocia în privat, secret, clauze contractuale pe miliarde de euro, bani publici, era în pușcărie, iar România ar fi fost dată ca exemplu eficient de luptă împotriva corupției.
O felicit pe Emily O'Reilly pentru că a avut curajul și perseverența să cerceteze acest comportament abuziv al Ursulei von der Leyen, atunci când alte instituții au tăcut. Vă îndemn să susțineți acest raport, mai ales Amendamentul 7, care solicită publicarea tuturor contractelor semnate de von der Leyen cu firmele producătoare de vaccinuri.

Φρέντης Μπελέρης (PPE). – Κυρία Πρόεδρε, οδεύοντας προς την εκλογή του νέου Ευρωπαίου Διαμεσολαβητή, είναι πολύ σημαντικό να συμφωνήσουμε στα εχέγγυα που πρέπει να διέπουν τη δράση του.
Πρώτον, να μην κάνει εκπτώσεις σε ζητήματα δημοκρατίας, κράτους δικαίου και ανθρωπίνων δικαιωμάτων, ακόμη και όταν αυτά αφορούν κράτη που βρίσκονται σε ενταξιακή πορεία. Στα ζητήματα αυτά δεν χωρούν εκπτώσεις. Στη δική μου περιπέτεια, δυστυχώς, δεν εμφανίστηκε ποτέ αυτή η ευαισθησία.
Δεύτερον, να μην υποκύπτει σε πιέσεις που έχουν ως βάση τον ανεξέλεγκτο δικαιωματισμό και να μην εργαλειοποιείται στο όνομα της κοινωνίας των πολιτών. Ειδικά στο μεταναστευτικό, αυτό συνέβη κατά κόρον. Δεν πρέπει να ξανασυμβεί. Μέχρι στιγμής αυτό που βλέπουμε ήταν μια στοχοποίηση συγκεκριμένων κρατών μελών με νομικά προσχήματα και χωρίς ουσιαστικά στοιχεία.
Ως θεσμός, λοιπόν, ο Ευρωπαίος Διαμεσολαβητής οφείλει να δρα με βάση την εντολή του, αμερόληπτα και ανεξάρτητα. Ως εγγυητής της νομιμότητας αλλά και της αξιοπιστίας της Ένωσής μας.
Mohammed Chahim (S&D). – Voorzitter, wat ben ik blij dat we in Europa een ombudsman hebben! Zeker wanneer we te maken hebben met overheden die de grenzen van de rechtstaat opzoeken, mensen willens en wetens apart zetten en onze vrijheden en rechten niet als vanzelfsprekend zien. Gelukkig hebben wij het instituut “Ombudsman” dat ons beschermt en ons tegelijkertijd een spiegel kan voorhouden.
Een voorbeeld hiervan is migratie, waar het debat steeds feller en feller wordt. Je zou bijna vergeten dat het om mensen gaat en dat die mensen gewoon rechten hebben. Terecht dat de Ombudsman daarom de afgelopen jaren verslag deed van Frontex en de Europese grenspolitie en hen opriep om de fundamentele rechten van migranten beter te beschermen.
Precies daarom hebben wij een ombudsman nodig. Iemand die los staat van de publieke opinie en oog houdt voor wat echt telt: mensenrechten, transparantie en vooral een eerlijke overheid. Ik hoop echt dat wij dat instituut nog meer waarde gaan toedragen en waardigheid gaan geven. Want het is belangrijk om een onafhankelijk iemand te hebben die opkomt voor mensen en ons af en toe een spiegel voorhoudt.
Adrián Vázquez Lázara (PPE). – Señora presidenta, señor vicepresidente, señora O'Reilly, mañana elegimos a quien le sucederá para los próximos cuatroaños como titular del Defensor del Pueblo Europeo, una institución clave en la protección de los derechos de los ciudadanos europeos y de los valores fundamentales de nuestra Unión.
La democracia y el Estado de Derecho no solo constituyen el sistema que rige nuestra organización política, sino que también son elementos centrales de nuestra identidad, y por esta razón tenemos que tomarnos muy en serio la labor que realiza el Defensor del Pueblo Europeo. Este organismo actúa como puente entre los europeos y sus instituciones, partiendo de la premisa de que, al igual que no hay democracia sin separación de poderes o igualdad ante la ley, tampoco puede haber democracia sin transparencia ni rendición de cuentas.
Sin embargo, y a pesar del gran trabajo que ha hecho usted, esa institución aún tiene mucho trabajo por delante. Durante la pasada legislatura, muchos europeos acudieron a este organismo con la esperanza de resolver dudas sobre procedimientos iniciados por la Comisión Europea en casos que afectan directamente a sus derechos fundamentales. Un ejemplo es el alto número de solicitudes presentadas por ciudadanos españoles para conocer el estado del procedimiento iniciado por la Comisión sobre la ley de amnistía. Por ello, pido que el próximo candidato refuerce los niveles de transparencia y rendición de cuentas de la Unión.
Evin Incir (S&D). – Madam President, first and foremost, I want to start by thanking you for your vital work, EU Ombudsman O'Reilly. In these challenging times of backlash against fundamental rights and democratic erosion your role as a strong EU Ombudsman with integrity has been crucial.
Transparency and access to documents are essential for democracy, protecting against corruption and authoritarianism. Unfortunately, the Commission and many Member States have consistently failed to meet these expectations. The Commission has excessively restricted access to documents and missed legal review deadlines in 85% of cases. Even President von der Leyen has denied public access to SMS communication with a pharmaceutical CEO, overlooking that content defines a public document, not the medium. Even a pigeon – a message sent by pigeon – would and should have been seen as a public document.
It's disheartening that Member States refuse to resume negotiations on the regulation of access to documents. The situation undermines the trust in the public institutions. It undermines the trust in democracy.

Regina Doherty (PPE). – Madam President, with democratic accountability under threat right across the world, including in some of our own Member States, I believe the role of the European Ombudsman has never been more important. EU citizens must feel that the institutions are not above scrutiny. And that is why I want to thank my own Irish colleague, Emily O'Reilly, for the service that she has given in this role for the last 11years.
Emily has given her absolute all to uphold democracy, enhance accountability and ensure that the abuses of power in EU institutions, including in this Ϸվ, do not get dismissed as 'It's just the way things are done'. Because I know there are citizens across the Union in every Member State who are extremely grateful to Emily for her work that she did on their behalf over three mandates. But that work is never complete and there is still much more to do.
The Commission in particular needs to become much better at giving public access to the legislative documents within a reasonable time frame, as she outlined, and I am sure that will be for our next EU Ombudsman and I want to wish them all the best of luck tomorrow. But Commissioner, after 11years of outstanding service of a fine Irishwoman and three of our candidates tomorrow being women, maybe it's about time we changed the name of the role to 'Ombudsperson'.
Michał Szczerba (PPE). – Pani Przewodnicząca! Pani Rzecznik! To bardzo ważna debata na temat sprawozdania za rok 2023, ale chcę wykorzystać okazję, żeby zwrócić uwagę na rolę Europejskiego Rzecznika Praw Obywatelskich w obronie naszych wspólnych wartości, jakimi są przejrzystość, bezstronność i praworządność. Chciałbym zwrócić uwagę również na to, że potrzeba jest większej widoczności tego urzędu. W przyszłości będziemy na tej sesji Parlamentu wybierać nowego rzecznika lub nową rzeczniczkę.
Chcę powiedzieć, że bardzo ważną rolę odgrywa współpraca z organizacjami pozarządowymi. Każdy obywatel i każda obywatelka mają prawo złożyć skargę. Ale chcę zwrócić uwagę na konieczność współpracy z organizacjami pozarządowymi zajmującymi się interesami osób starszych, interesami osób z niesamodzielnością, niepełnosprawnością, w kryzysie bezdomności. Również istotną nową rolą rzecznika powinno być zwrócenie uwagi na kwestie migracji i azylu.

Maria Grapini (S&D). – Doamnă președintă, încep și eu prin a vă felicita, doamna Ombudsman, pentru cei zece ani de muncă și ați rămas și rămâneți un reper pentru curaj, foarte multă tenacitate și asumare în analiza și în activitatea pe care ați făcut-o. Dar vreau să mă adresez domnului comisar.
Domnule comisar, ați observat că toată lumea a lăudat Ombudsmanul și a criticat Comisia. Dumneavoastră erați un critic al Comisiei din punct de vedere al lipsei de transparență. Eu sper, domnule comisar, că îi veți transmite doamnei președintă a Comisiei și veți sprijini noul Ombudsman în sfârșit, să înțeleagă că atât Ombudsmanul, cât și Parlamentul au dreptul, dar și obligația de a cere explicații Comisiei atunci când dă dovadă de lipsă de transparență.
Este foarte important să întărim, de asemenea, legătura Ombudsmanului European cu ombudsmanul statelor membre. Sunteți un exemplu și poate ar trebui ca acest raport al activității dumneavoastră să ajungă la toți ombudsmanii din cele 27 de state, pentru că avem nevoie de o legătură mai strânsă. Cetățenii au nevoie să cunoască mai bine activitatea Ombudsmanului și să poată apela pentru că, până la urmă, democratic, avem nevoie de acest mediator.
Sebastian Tynkkynen (ECR). – Arvoisa puhemies, kun meillä on niin valtava vallankäyttäjä kuin EU, sillä jos jollain pitää olla vallan vahtikoiria. Tässä himmelissä vahtikoirille nimittäin riittää älähdettävää. Mitä me olemmekaan nähneet viime vuosien aikana EU:n huipulla? Esimerkiksi miljardien eurojen arvosta tehtyjä kauppoja, joita on toteutettu tekstiviestein. Tilintarkastustuomioistuin on tehnyt toistuvasti löydöksiä, jotka paljastavat, kuinka tässä EU-suossa rahaa käytetään jatkuvasti väärin. Viime kaudella luotu elpymispaketti on paljastunut väärinkäytösten kannalta piileväksi pommiksi. Ja vieläkö joku ihmettelee, mikseivät kansalaiset luota EU:hun? Neuvoni EU-eliitille on, että älkää pelästykö EU-kritiikkiä. Kuunnelkaa sitä tarkalla korvalla ja ottakaa opiksenne. Siten EU:sta saattaa tulla huomenna parempi kuin mitä se on tänään.
João Oliveira (The Left). – Senhora Presidente, começo por saudar a Senhora Provedora Europeia e o relatório que nos apresentou sobre o trabalho realizado em 2023, que é um belíssimo retrato daquilo que é a realidade hoje na União Europeia, daqueles a quem se permite que tudo façam e daqueles que são duramente prejudicados pela realidade europeia, pela União Europeia e pelas suas políticas.
Destaco dois aspetos do relatório apresentado pela Senhora Provedora: um relativo aos escândalos bancários e outro relativo às migrações.
A forma como a Provedoria Europeia interveio nas queixas feitas sobre a atuação de autoridades bancárias e financeiras, incluindo o impacto dos escândalos financeiros, como o do Banco Popular ou o escândalo das taxas LIBOR, mostra como a banca pode fazer tudo aquilo que entende em prejuízo dos cidadãos, com os cidadãos a assumirem essas consequências e, com grandes dificuldades, as autoridades a impedirem esse tipo de práticas.
Simultaneamente, a intervenção da Provedoria Europeia em matéria de migrações em relação a violências e abusos contra migrantes e refugiados e em relação a práticas ilegais de devoluções forçadas ou a outras práticas da Frontex que são criticadas pela Provedoria Europeia. Essas, inevitavelmente, fazem uma marca na vida dos migrantes. Esta é uma marca de desigualdade da União Europeia.
Lukas Sieper (NI). – Madam President, dear people of Europe and dear secretaries of the Vice-President. The European Ombudsman is an institution of transparency, and while the annual report of 2023 shows how important this institution is given the fact that 372 proceedings have been concluded, it also shows us the price of transparency. It is not for free – it takes the involved institutions some bravery, because what stands in the way of transparency is mostly the thought that things always have been like that.
If, for example, a Member of this Ϸվ uses the freedom of his mandate to record from inside this plenary and thereby give the people a unique insight to the proceedings of this House, this, of course, is also a disturbance to the way that things have been. But if you ask me, transparency is always worth that disturbance.
Dear colleagues, let us do everything in our power to strengthen the European Ombudsman even further.

Raffaele Fitto, Executive Vice-President of the Commission. – Madam President, honourable Members, dear Ms O'Reilly, thank you for all your interesting interventions.
Good administration is not only a concept – it is a right enshrined in the Treaties and the Charter of Fundamental Rights. The demands and the needs from EU citizens, businesses and associations for transparent, accessible and efficient EU institutions based upon principles – notably of non-discrimination, impartiality, objectivity and fairness – are therefore legitimate, reasonable and valid. This is why cooperation between the European Ombudsman and the EU institutions is of key importance.
The report and the resolution of the European Ϸվ on the activities of the European Ombudsman in 2023 highlighted several areas where the institutions have done their job and others where improvements can be realised. It is our duty to strive to improve the way we operate, in line with the principle of good administration, in the interests of the EU citizens and the interests of the European Union.
As already mentioned in my introductory remarks, the Commission will now assess in detail the issues raised in your resolution and during today's debate and will respond in the next weeks. Thank you for your attention.
EMILY O'REILLY, European Ombudsman. – Madam President, dear Members, thank you very much for all of your kind words and your observations. If it is feeling a bit like my funeral, as Madam Toom said, it's a very nice one. I'm sure my successor will pay attention to everything that you have said today and listen to your priorities and those issues that you have taken particular interest in.
As I have said many times before, the support of Ϸվ for an EU Ombudsman's work is both vital for and intrinsic to its capacity to be successful in its work. We both have the task of holding the executive to account, and that implies a shared sense of values and a shared concern for the citizens of the European Union, whose lives are determined in so many ways by what happens in this Chamber and in the offices and meeting places of the other institutions, agencies, offices and bodies.
Over the last eleven years, whenever I have asked for the support of this Ϸվ, I have received it, and it is that that I have relied on when challenges arose and your institutional strength was needed to assist me in overcoming them. I thank you again for that.
Such successes as I have had in those eleven years have also been built on my belief in belief itself. Institutions such as the European Ϸվ have enormous power, and even my small office, inspired by my own strong belief in its capacity to make positive change within the European administration, has considerable power if we choose to internalise a deep awareness of that potential and how we can use it.
This Ϸվ is directly elected by the people, and that legitimacy confers upon you both great power and great responsibility. Tomorrow you will elect my successor, and I wish you well in that important task. Whoever is chosen will have the legitimacy conferred precisely because of their election by you, by this institution, and that, too, will be a source of great strength to them, and will also confer great responsibility.
It has been an honour and an immense privilege to have served in this role. I will leave you with a few words of farewell in my native Irish language. They come from an old Irish blessing, wishing a traveller well as they embark on a journey, just as I wish you all well as you continue on yours.

Marc Angel (S&D), in writing. – The European Ombudsman has a key role when it comes to ensuring transparency and accountability of the EU administration.
This PETI annual report is the last under the outgoing Ombudsman Emily O'Reilly, whom I want to thank for the remarkable and tireless work of the past eleven years.
Accountability, transparency, compliance with fundamental and human rights obligations are some of the elements investigated by the Ombudsman in 2023. Such values are the cornerstone of our Union and I am glad that the Ombudsman’s recommendations helped to improve the functioning of our institutions with tangible results.
Citizens expect an 'open, modern and service-minded' EU administration, but unfortunately, a lot still has to be done to achieve the highest possible standards.
Particularly worrying are the systemic and significant delays in how the Commission handles requests for public access to documents. Regrettably, other EU institutions have been facing the same issue, which is a sign of widespread structural problems.
I also welcome the assessment regarding ethical issues in the EU institutions and the concerns on the implementation of the new rules on transparency.
Transparency lies at the basis of the citizens’ trust and we need to maintain high accountability and ensure proper enforcement.
