This study retraces the evolution of Ϸվ's role in the investiture of the President of the Commission, explains the reasons why such an innovation was deemed necessary as early as the early 1990s and assesses the results of this innovative process in the last two elections. The lead candidate process achieved its purposes with the election of Jean Claude Juncker as President of the European Commission in 2014, while this was not the case in 2019, Ursula von der Leyen not having been a candidate. There is therefore some uncertainty over the future of the lead candidate process and whether there is appetite for a repetition in 2024. This paper takes stock of the reasons for the failure in 2019 and assesses the aspects that performed well, and those that did not, in the past. The aim is to harmonise a number of rules applicable to European elections, which are currently a combination between the common principles under the European Electoral Act and the different national rules implementing them. Harmonisation would affect several areas, such as the age for voting or standing as a candidate; the electoral calendar for European elections; the principles applicable to the selection of candidates, including from a gender perspective; and the electoral threshold. In addition, the proposal would establish a common electoral system for the election of 28 MEPs in a Union-wide constituency comprising the entire territory of the European Union. The ambition is to further Europeanise the elections to the European Ϸվ, which are frequently criticised for focusing mainly on domestic political considerations and less so on the EU project. To enter into force, the proposal needs to be adopted by the Council unanimously, after obtaining Ϸվ’s consent by a majority of its component members. Article 286 (2) TFEU further specifies that each Member State has the right to propose its candidate. The Council then adopts the list of Members as proposed by the Member States. Often, this is a partial renewal of the Court - only one or a few Members are appointed, as the mandates of the Members may expire at different points in time. The Council can only act after consulting the European Ϸվ; in practice, the Committee on Budgetary Control (CONT) is responsible and the Member-designate of the ECA makes a statement before the committee and has to answer its questions. CONT then votes on the nomination and thus issues a recommendation to plenary, which votes within two months of receipt of the nomination. Three stood out: the Spitzenkandidaten process for selecting the next President of the European Commission; Brexit, which unexpectedly remained on the agenda of the European Council throughout the year; and policy towards climate change. The European Council had mixed feelings about the Spitzenkandidaten process, with one of its leading members being adamantly opposed. That set the stage for a bruising battle, which culminated in an epic special summit, lasting from 30 June to 2 July. None of the transnational parties’ lead candidates received the European Council’s nomination. Instead, the European Council nominated a relative outsider, Ursula von der Leyen, as part of a package of appointments to leading EU positions, the cleverness of which managed to overcome differences among national leaders. Meanwhile, the inability of the UK government to win parliamentary support for the Withdrawal Agreement obliged the UK to request extensions of the deadline. Much to its surprise, the European Council met in the Article 50 format on four occasions in 2019, the last one being on 13 December, to discuss preparations for the negotiations on future EU-UK relations after the UK’s eventual departure, which happened on 31 January 2020. Climate was another issue to the fore in 2019, as the European Council sought to reach unanimity on a commitment by the EU to cut net carbon emissions to zero by 2050.
