Upon request by the Committee on Legal Affairs, this handbook, provided by the Policy Department for Citizens’ Rights and Constitutional Affairs, summarises, in its first part, the EU legal framework on the incompatibilities and immunity of Members of the European �Ϸ��վ. Based on national reports, the second part of the handbook gives an overview, for each EU Member State, of the relevant national provisions on the composition of national governments and parliaments as well as those on national parliamentary immunities. This handbook will be updated regularly based on information received; please hold as reference the date of edition.

It examines the legal position of EU officials and other servants of British nationality with their rights and possible remedies. It further explores avenues towards solutions for open legal questions.

Briefing - The Implementation of the Environmental Liability Directive: A Survey of the Assessment Process Carried Out by the Commission - 06-06-2016

By letter dated 26 January 2016 the Legal Affairs Committee requested the Policy Department for Citizens’ Rights and Constitutional Affairs to commission a research project looking into the way Directive 2004/35/CE of the European �Ϸ��վ and of the Council of 21 April 2004 on environmental liability with regard to the prevention and remedying of environmental damage (ELD) is applied in the Member States with a view to putting forward conclusions and recommendations for future policy steps.

Over the last decades, the European Union has developed a series of ad hoc administrative procedures for the direct implementation of its rules in a number of areas - such as competition policy, trade policy, sate aids, access to EU documents, the EU civil service - , which resulted in a fragmented body of rules, whether in the form of law or soft law. The need to depart from this sector-specific approach to ensure consistent EU administrative procedures has therefore started to be debated in the academic sector as well as within the EU institutions. In this respect, following the entry into force of a new legal basis on administrative law introduced by the Lisbon Treaty the European �Ϸ��վ has called for the adoption of a single European Administrative Procedure binding on its institutions, bodies, agency and offices including enforceable procedural rights for citizens when dealing with the Union's direct administration.

This handbook provides the Committee on Legal Affairs with a practical tool aimed at simplifying its tasks when verifying the credentials of the newly elected Members of the European �Ϸ��վ, when ruling on the validity of their mandate or when considering requests for the waiver or defence of parliamentary immunity. The handbook is intended for internal use only and does not purport to be an exhaustive study on the incompatibilities and immunity of the Members. The first part of the handbook briefly recalls the legal framework governing the verification of the credentials and the immunity of Members of the European �Ϸ��վ. A detailed analysis of the legislative and procedural rules on the mandate of Members is available in the following studies published by the Policy Department: "Election and mandate of MEPs" and "�Ϸ��վary immunity in the European �Ϸ��վ". The second part of the handbook is composed of national reports summarising for each Member State the relevant national provisions on parliamentary immunity and on those national offices which are incompatible with the office of a Member of the European �Ϸ��վ, according to Article 7(1) and (2) of the Act concerning the election of the Members of the European �Ϸ��վ by direct universal suffrage. Each national report is therefore divided into two chapters. The first chapter sets out the legal provisions on the composition of national governments and parliaments, the denomination of their respective members and the date of the beginning of their term of office. The second chapter provides an overview of national rules on parliamentary immunity and identifies the national authorities which are competent to request the waiver of Members' immunity. Lastly, two annexes reproduce the lists of national authorities entitled to notify the names of newly elected Members to the European �Ϸ��վ and those competent to request the waiver of a Member's immunity.
