Den europeiska integrationen har lett till att de nationella parlamentens roll har förändrats. Olika instrument för samarbete mellan Europaparlamentet och de nationella parlamenten har tagits fram för att garantera effektiv demokratisk kontroll av EU:s lagstiftande på alla nivåer. Denna tendens har stärkts i och med de bestämmelser som har tillkommit genom Lissabonfördraget.

Briefing - What has the European Union done in the field of migration since 2014? - 15-06-2017

In response to the migration challenge, on 13 May 2015 the European Commission presented the European Agenda on Migration, with the aim of setting out a comprehensive approach for improving the management of migration in all its aspects. Several implementation packages under the Agenda have already been adopted and the measures therein are starting to be deployed; legislative proposals have also been made and are currently being discussed in �Ϸ��վ and Council.

Det straffrättsliga samarbetet bygger på principen om ett ömsesidigt erkännande av domar och rättsliga avgöranden, och inbegriper åtgärder för tillnärmning av medlemsstaternas lagar på olika områden. Lissabonfördraget har stärkt grunden för ett straffrättsligt område, och föreskriver dessutom nya befogenheter för Europaparlamentet.

Briefing - Prison Conditions in the Member States: Selected European Standards and Best Practices - 17-01-2017

This paper provides an overview of European standards and good practices regarding prison conditions. Action by the EU in the field of judicial cooperation in criminal matters is affected by detention conditions across EU Member States. The Council of Europe has adopted numerous recommendations and standards on conditions of life in prison, and the European Court of Human Rights has found that detention conditions may breach the prohibition against torture and ill-treatment. The paper provides an overview of common problems affecting prisons in the EU Member States (from overcrowding to general conditions of life in prison) and describes some of the identified best practices to solve them. Specific attention is paid to pre-trial detention, to the use of alternative (non-custodial) measures, to measures aimed at social reintegration and prevention of recidivism, and to the special safeguards and standards developed as regards vulnerable prisoners (such as children, women, or mentally ill detainees).

Briefing - Public International Law Perspectives on the Prosecution of Daesh Crimes Against Women And Girls - 02-12-2016

The perpetration of gender-based crimes by Daesh against women and girls has been widely reported by competent international bodies as well as in the media, raising concern and indignation amongst the public worldwide . From a legal perspective, the question is how to address such crimes, and in particular how to prosecute their perpetrators. On 13 October 2016, the European �Ϸ��վ’s Committees on Legal Affairs (JURI) and on Women’s Rights and Gender Equality (FEMM) held a joint hearing on ‘Public international law perspectives on the prosecution of Daesh’s crimes against women and girls before international jurisdictions’ . During the hearing, three experts were heard. The present briefing builds on discussions held during the hearing, as well as on academic and judicial developments in the field of international criminal law, with the aim of highlighting possible avenues to ensure that sexual and gender-based crimes committed by Daesh do not remain unpunished.

Upon request by the JURI Committee, this in-depth analysis examines the immunity of Members of the European �Ϸ��վ. It describes the scope of their immunity, as clarified by the Court of Justice of the European Union, together with the procedures followed by �Ϸ��վ in cases of waiver or defence of parliamentary immunities. Lastly, it looks at the practice of the competent committee in order to infer the general principles underlying its decisions.

Studie - Handbook on the Incompatibilities and Immunity of the Members of the European �Ϸ��վ - 07-08-2014

Upon request by the Legal Affairs Committee, this handbook describes the national rules on the composition of the governments and parliaments of each of the Member States of the European Union and provides an overview of the national rules on parliamentary immunities. It further lists the national authorities that are competent to request the waiver of MEPs immunity, as identified after consultation with the Member States. This text will be updated regularly, on the basis of information received; please hold as reference the date of edition.

Upon request by the LIBE Committee, this internal note provides background information for the delegation of the Committee on civil liberties, justice and home affairs (LIBE) to Italy on the situation of prisons on 26-28 March 2014. After a preliminary overview of some initiatives on detention conditions at EU level (by the European �Ϸ��վ and the European Commission), the note analyses the Italian situation regarding overcrowding of prisons and conditions of detention, defined by the Council of Europe and the European Court of Human Rights as inhuman and degrading treatment in some cases. The note also refers to recent Italian legislative and jurisprudential developments, whose effects on the situation of prisons have yet to be determined.

Studie - Dissenting Opinions in the Supreme Courts of the Member States - 15-11-2012

This study examines the advantages and disadvantages of the practice of separate opinions. After an analysis of its diffusion in the Member States' Supreme and Constitutional Courts, it presents the practice of international tribunals. Finally, the reasons why the publication of separate opinions may, or may not, be suited for the CJEU are also taken into consideration.
