Motion for a European Ϸվ resolution on the torture and criminal prosecution of Ukrainian minors Tihran Ohannisian and Mykyta Khanhanov by the Russian Federation

Ϸվ,
having regard to its previous resolutions on Ukraine and the Russian Federation,
–having regard to Rule 144 of its Rules of Procedure,
- whereas on 24 May 2023, the Investigative Committee of the Russian Federation charged two Ukrainian children, Tihran Ohannisian and Mykyta Khanhanov, both born in 2006, with conspiring with the Ukrainian armed forces and planning sabotage actions on the Melitopol Railway in the occupied Ukrainian region of Berdyansk, under Article 281 of the Russian Criminal Code; whereas both the children and Ukraine’s Center for the National Resistance have rejected the accusations;
- whereas prior to the indictment, Tihran was reportedly taken for interrogation, including a simulation of execution and torture with electric current; whereas both children have subsequently been under house arrest since autumn 2022;
- whereas Tihran and Mykyta are facing 10 to 20 years in prison; whereas the children do not receive proper legal help under the Russian occupation with the appointed lawyers not acting in their defence; whereas it is expected that Tihran and Mykyta will soon be arrested and placed on a show trial;
- Condemns the sham prosecution and reported torture of Ukrainian minors Tihran Ohannisian and Mykyta Khanhanov by the Russian occupation forces and demands that the charges against them are dropped immediately and unconditionally;
- Emphasises that the case of Tihran and Mykyta is part of an established policy of the Russian occupying "authorities" to detain, torture and prosecute Ukrainians, activists, journalists and even children;
- Emphasises that the reports on this case point to direct violations by Russia of the United Nations International Convention on the Rights of the Child and the Geneva Convention (IV) relative to the Protection of Civilian Persons in Time of War;
- Calls on the EEAS and Member States to follow the case of Tihran and Mykyta as closely as possible and assist Ukraine in the collection of evidence in such cases, to be used in future criminal trials of those responsible; calls on the UN Special Representative of the Secretary-General on Violence Against Children to investigate the case;
- Urges Russia to immediately cease its systematic abductions and mistreatment of Ukrainian civilian hostages in the illegally occupied territory of Ukraine and in Russia, and demand the immediate release of all individuals unlawfully deprived of their liberty; highlights in this regard the case of the unlawfully detained Ukrainian journalist Iryna Danylovych whose court hearing will take place in Crimea this week and who risks being deported to Russia despite her rapidly deteriorating health;
- Reiterates its demand that Russia immediately and unconditionally withdraw its forces from the territory of Ukraine within its internationally recognized borders;
- Instructs its President to forward this resolution to the VP/HR, the Council, the Commission, the governments and parliaments of the Member States, the President, Government and Verkhovna Rada of Ukraine, and to the President, Government and the Ϸվ of the Russian Federation.
