Motion for a European Ϸվ resolution on the torture and criminal prosecution of Ukrainian minors Tihran Ohannisian and Mykyta Khanhanov by the Russian Federation

Ϸվ,

having regard to its previous resolutions on Russia’s war of aggression against Ukraine,

having regard to the Geneva Conventions,

having regard to Rule 144 of its Rules of Procedure.

  1. whereas on 24 May 2023 Ukrainian teenagers Tihran Ohannisian and Mykyta Khanhanov were charged by the Investigative Committee of the Russian Federation for allegedly planning to sabotage railways in the Ukrainian city of Berdyansk and face severe sentences of up to 20 years in prison under Article 281 of the Russian Criminal Code;
  2. whereas Tihran Ohannisian who was abducted from his home, and Mykyta Khankanov have allegedly been subjected to brutal interrogations, torture and house arrest since September 2022 while their families were prevented access to their children and subjected to repression;
  3. whereas there is a lack of adequate legal defence given the atmosphere of fear, repression and impunity in the temporarily Russian-occupied territories of Ukraine;
  4. whereas Ukrainian children and teenagers are the most vulnerable victims of Russia’s war of aggression against Ukraine and many of them have been traumatised, wounded or even killed;

1.Urges Russia to immediately release Tihran Ohannisian and Mykyta Khanhano from house arrest and to cease their mistreatment as well as that of any other Ukrainian citizen detained in Russia and or in the territories of Ukraine currently occupied by Russia;

2.Calls on the Russian authorities to urgently allow diplomats, lawyers and representatives from international organizations access in order to assess the health and psychological condition of the two teenagers as well as their needs for emergency aid;

3.Demands that Russia treat all Ukrainians in Russian captivity or living in territories currently occupied by Russia in full compliance with international humanitarian law;

4.Condemns Russia’s actions deliberately targeting Ukrainian children and teenagers, including their detention, mistreatment, forcible transfer within parts of Ukraine’s territory temporarily occupied by Russia, unlawful deportation to Russia and Belarus and forcible adoptions by Russian families as well as their so-called “re-education”;

5. Considers that the forcible deportation of thousands of Ukrainian children and teenagers to Russia and Belarus could qualify as a genocidal crime and is a particularly atrocious aspect of Russia’s war and Russia’s many war crimes; therefore welcomes the arrest warrants issued by the International Criminal Court against the President of the Russian Federation and the so-called Commissioner for Children’s Rights in the Office of the President and calls on the international community to establish accountability for all the war crimes committed in Ukraine and against the people of Ukraine;

6.Reiterates its call on the Commission and the Council to adopt an EU-Ukraine Child Protection Package for children fleeing or affected by the war;

7.Instructs its President to forward this resolution to the Vice-President of the Commission/ High Representative of the Union for Foreign Affairs and Security Policy, the Council, the Commission, the governments and parliaments of the Member States, the Council of Europe, the OSCE and to the President, Government and Ϸվ of the Russian Federation.
