Motion for a European Ϸվ resolution on the deterioration of fundamental freedoms in Hong Kong, notably the case of Jimmy Lai

Ϸվ,
- having regard to its previous resolutions on Hong Kong,
- having regard to Rule 144 of its Rules of Procedure,
- whereas the promotion of and respect for human rights, democracy and the rule of law should remain at the centre of the long-standing relationship between the EU and the People’s Republic of China (PRC);
- whereas on 28 February 2020, Jimmy Lai, the founder of the pro-democracy news outlet Apple Daily in Hong Kong, was arrested and later sentenced in four cases relating to unauthorised assembly and in one case relating to fraud;
- whereas Jimmy Lai is currently facing trial under the National Security Law (NSL) with a potential life sentence; whereas on 30 December 2022, Beijing’s National People’s Congress Standing Committee decided that Hong Kong courts have to request certification from the Chief Executive on the participation of foreign lawyers in national security cases resulting in a refusal of further visa applications from the foreign-based lawyer Timothy Owen , who represents Jimmy Lai at trials;
- whereas since the entry into force of the NSL, the freedom of expression in Hong Kong is declining and the rule of law, independence of judiciary and human rights situation in Hong Kong has deteriorated alarmingly:
- Calls on the authorities of the Hong Kong Special Administrative Region (SAR) to release Jimmy Lai and drop the charges against him;
- Reiterates its call on authorities drop all criminal charges against pro-democracy and civil rights activists and immediately release those who exercised their right to freedom of expression and human rights; calls on to the PRC and Hong Kong authorities to fully abide by the International Covenant on Civil and Political Rights;
- Urges the PRC authorities to repeal the NSL and to recommit to the Hong Kong Basic Law, which guarantees freedom of association, freedom of assembly, freedom of expression and freedom of religion and belief;
- Reiterates its call for the Council to introduce targeted sanctions all Hong Kong and PRC officials responsible for the ongoing human rights crackdown in the city; urges the remaining EU Member States to suspend active extradition treaties with the PRC and Hong Kong;
- Instructs its President to forward this resolution to the Council, the Commission, the VP/HR, the Government and Ϸվ of the People’s Republic of China, the EU Office in Hong Kong, the Chief Executive and Legislative Council of the Hong Kong SAR.
