European Ϸվ legislative resolution of 23 April 2024 on the proposal for a decision of the European Ϸվ and of the Council amending Directive 2014/62/EU as regards certain reporting requirements ( – C9-0382/2023 – )

(Ordinary legislative procedure: first reading)

Ϸվ,

–having regard to the Commission proposal to Ϸվ and the Council (),

–having regard to Article294(2) and Article83(1) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Ϸվ (C9‑0382/2023),

–having regard to Article294(3) of the Treaty on the Functioning of the European Union,

–having regard to the undertaking given by the Council representative by letter of 17 April 2024 to approve Ϸվ’s position, in accordance with Article 294(4) of the Treaty on the Functioning of the European Union,

–having regard to Rule 59 of its Rules of Procedure,

–having regard to the report of the Committee on Civil Liberties, Justice and Home Affairs (A9-0152/2024),

1.Adopts its position at first reading hereinafter set out;

2.Calls on the Commission to refer the matter to Ϸվ again if it replaces, substantially amends or intends to substantially amend its proposal;

3.Instructs its President to forward its position to the Council, the Commission and the national parliaments.

(Amendment applies throughout (with the exception of footnotes): replace the words ‘Decision’ throughout the Commission's proposal by the word ‘Directive’.)

Recital 4 a (new)
(4a)This Directive is based on a careful assessment of the particular circumstances of this legal instrument and limited to this area of crime. It is without prejudice to the need to ensure appropriate levels of reporting obligations in the field of EU criminal law.

(6)In accordance with Article 3 of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, annexed to the TEU and to the TFEU, Ireland has notified its wish to take part in the adoption and application of this Decision ”OR “In accordance with Articles 1 and 2 of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, annexed to the TEU and to the TFEU, and without prejudice to Article 4 of that Protocol, Ireland is not taking part in the adoption of this Decision and is not bound by it or subject to its application.” ].
(6) In accordance with Article 3 and Article 4a (1) of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, annexed to the TEU and to the TFEU, Ireland has notified its wish to take part in the adoption and application of this Directive.

(7)Directive 2014/62/EU should therefore be amended accordingly.
(7) Directive 2014/62/EU should therefore be amended accordingly. Since the targeted amendment of that Directive solely concerns a deletion of a reporting obligation, there is no specific need for the Member States to transpose the amendment.
