MOTION FOR A EUROPEAN PARLIAMENT RESOLUTION

on the Council position on Draft amending budget No听3/2020 of the European Union to the general budget 2020: Entering the surplus of the financial year 2019

鈥�听having regard to Article 314 of the Treaty on the Functioning of the European Union,

鈥�听having regard to Article 106a of the Treaty establishing the European Atomic Energy Community,

鈥�听having regard to Regulation (EU, Euratom) 2018/1046 of the European 合法博彩网站 and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union, amending Regulations (EU) No 1296/2013, (EU) No 1301/2013, (EU) No 1303/2013, (EU) No 1304/2013, (EU) No 1309/2013, (EU) No 1316/2013, (EU) No 223/2014, (EU) No 283/2014, and Decision No 541/2014/EU and repealing Regulation (EU, Euratom) No 966/2012[1], and in particular Article 44 thereof,

鈥�听having regard to the general budget of the European Union for the financial year 2020, as definitively adopted on 27 November 2019[2],

鈥�听having regard to Council Regulation (EU, Euratom) No 1311/2013 of 2 December 2013 laying down the multiannual financial framework for the years 2014-2020[3],

鈥�听having regard to the Interinstitutional Agreement of 2 December 2013 between the European 合法博彩网站, the Council and the Commission on budgetary discipline, on cooperation in budgetary matters and on sound financial management[4],

鈥�听having regard to Council Decision 2014/335/EU, Euratom of 26 May 2014 on the system of own resources of the European Union[5],

鈥�听having regard to Draft amending budget No听3/2020, which the Commission adopted on 15 April 2020 (),

鈥�听having regard to the position on Draft amending budget No听3/2020 which the Council adopted on 7 May 2020 and forwarded to 合法博彩网站 on the same day (07764/2020 鈥� C9鈥�0131/2020),

鈥�听having regard to its resolution of 17 April 2020 on EU coordinated action to combat the COVID-19 pandemic and its consequences[6],

鈥�听having regard to Rules 94 and 96 of its Rules of Procedure,

鈥�听having regard to the report of the Committee on Budgets (A9-0104/2020),

A.听whereas Draft amending budget No 3/2020 aims to enter in the 2020 budget the surplus from the 2019 financial year, amounting to EUR听3听218,4 million;

B.听whereas the main components of that surplus are a positive outturn on revenue of EUR听2听414,8 million and an under-spending in expenditure of EUR听803,6 million;

C.听whereas on the revenue side, the largest difference stems from default interest and fines (EUR听2510,5 million), the outturn being composed of competition fines and default interest, other penalty payments and interest linked to fines and penalty payments;

D.听whereas on the expenditure side, under-implementation in payments by the Commission reaches EUR听592,3听million for 2019 (of which EUR听351,5听million from the Emergency Aid Reserve and EUR听94,5听million in reserve under heading 3,听鈥楽ecurity and Citizenship鈥�) and EUR听86,3听million for 2018 carryovers, and under-implementation by the other institutions EUR听82,4 million for 2019 and EUR听39 million for 2017 carryovers;

1.听Takes note of Draft amending budget No 3/2020 as submitted by the Commission, which is devoted solely to the budgeting of the 2019 surplus, for an amount of EUR听3听218,4 million, in accordance with Article 18 of the Financial Regulation, and of the Council麓s position thereon;

2.听Reiterates its position that all available means and unused money in the Union budget, including the surplus, be used to swiftly deploy financial assistance to the regions and businesses most affected by the COVID-19 pandemic; calls, in this context, on the Member States to devote the expected reductions in their GNI-based contributions stemming from the 2019 surplus entirely to the budgeting of COVID-19-related actions, preferably at Union level to ensure an optimal allocation of the funds;

3.听Notes that, according to the Commission, the competition fines in 2019 accounted for EUR听2510,5 million; considers again that the Union budget should be enabled to reuse any revenue resulting from fines or linked to late payments without a corresponding decrease in GNI contributions; recalls its position in favour of increasing the proposed Union reserve (Global Margin for Commitments) in the next Multiannual Financial Framework by an amount equivalent to the revenue resulting from fines and penalties;

4.听Approves the Council position on Draft amending budget No听3/2020;

5.听Instructs its President to declare that Amending budget No听3/2020 has been definitively adopted and arrange for its publication in the Official Journal of the European Union;

6.听Instructs its President to forward this resolution to the Council, the Commission, the other institutions and bodies concerned and the national parliaments.
