on the draft Council decision on the conclusion, on behalf of the Union and its Member States, of a Protocol amending the Common Aviation Area Agreement between the European Union and its Member States and the Republic of Moldova, to take account of the accession to the European Union of the Republic of Croatia

having regard to the draft Council decision (07048/2015),

having regard to the draft Protocol amending the Common Aviation Area Agreement between the European Union and its Member States and the Republic of Moldova, to take account of the accession to the European Union of the Republic of Croatia (07047/2015),

having regard to the draft Common Aviation Area Agreement between the European Union and its Member States, of the one part, and Moldova, of the other part,

having regard to the request for consent submitted by the Council in accordance with Articles100(2) and Article 218(6), second subparagraph, point (a), of the Treaty on the Functioning of the European Union (C9-0195/2019),

having regard to Rule 105(1) and (4) and Rule 114(7) of its Rules of Procedure,

having regard to the recommendation of the Committee on Transport and Tourism (A9-0083/2020)

1.Gives its consent to the conclusion of the Protocol;

2.Instructs its President to forward its position to the Council and the Commission and to the governments and parliaments of the Member States and the Republic of Moldova.


EXPLANATORY STATEMENT

This Protocol to the Common Aviation Area Agreement between the EU and its Member States and the Republic of Moldova takes into account the accession of Croatia to the EU on 1July2013. The Agreement itself is part of the EU Eastern Partnership and wider EU neighbourhood policy. The existing bilateral agreements on air traffic services between the EU Member States and Moldova are to be superseded by this new Agreement.

Procedure

The Common Aviation Area Agreement has been negotiated by the Commission as authorised by the Council in June 2011 and it was signed on 26 June 2012, subject to its conclusion at a later date, in accordance with Decision 2012/639/EU[1]. Following the accession of Croatia into the EU this Protocol on the accession of the Republic of Croatia to this Agreement was signed on 22 July 2015[2].

In order to conclude the Protocol to the Agreement the Council needs the consent of the European Ϸվ as required by Article 218 TFEU.

In accordance with Rules 105 and 114(5), (7) and (8) of Ϸվ’s rules of procedure, the committee responsible shall submit a recommendation for the approval or rejection of the proposed act. Ϸվ shall then take a decision by means of a single vote, and no amendments to the Agreement may be tabled. Amendments in committee shall be admissible only if their aim is to reverse the recommendation proposed by the rapporteur.

Main provisions of the Agreement

This Protocol does not change the substance of the Common Aviation Area Agreement with Moldova, which is part of the EU neighbourhood policy. It builds upon and replaces the framework of bilateral air transport agreements between the EU Member States and Moldova through the establishment of the Common Aviation Area between the EU and its Eastern Partnership Partners. It provides for gradual market opening in terms of access to routes and capacity on a reciprocal basis, ensures level playing field for economic operators based on the EU principles and provides for alignment of the Moldavian aviation legislation with EU legislation on issues such as safety, security and air traffic management.

Rapporteur’s position

This Protocol takes into account the accession of Croatia to the EU and does not modify the substance of the Agreement itself, to which the Rapporteur has already recommended consent in the separate recommendation, In the light of the above, the Rapporteur suggests that the TRAN Committee should also give a favourable recommendation on the conclusion of the Protocol.
